HUSTLORY provides an online platform where customers can browse, purchase, and download digital creative products, including digital asset designs, stock PNG assets, printable graphics, templates, editable design files, AI-assisted creative assets, and other downloadable merchandise.
We respect the intellectual property rights of others and expect all users, contributors, and third-party content providers associated with HUSTLORY to do the same. We do not allow any product, design, artwork, image, template, file, or other content on our store that infringes the copyright, trademark, or other intellectual property rights of any third party.
If you believe that any content available on or through the HUSTLORY website infringes your intellectual property rights, please contact us using the procedure below.
A. Procedure for Reporting Intellectual Property Infringement
It is HUSTLORY’s policy to:
- Remove or disable access to any content, product listing, digital file, image, artwork, template, graphic, or related material that we believe in good faith may infringe the intellectual property rights of a third party after receiving a valid infringement notice; and
- Take appropriate action against repeat infringers, including removing content and restricting or terminating access to our services where applicable.
If you believe that any content, digital product, downloadable file, artwork, design, image, template, or other material available on the HUSTLORY website infringes your copyright, trademark, or other intellectual property rights, please send a notice of infringement containing the following information to our Designated Agent:
- Identification of the copyrighted work, trademark, or other intellectual property that you claim has been infringed, including any registration number if applicable;
- Identification of the content or product that you claim is infringing, including:
- A description of how the material is using your copyrighted work, trademark, or intellectual property without authorization; and
- The exact URL, product page, file name, or other location where the allegedly infringing material appears on the HUSTLORY website;
- Your contact information, including your full name, mailing address, telephone number, and email address;
- A statement that you have a good faith belief that the disputed use is not authorized by the rights holder, its agent, or the law;
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or are authorized to act on behalf of the rights holder; and
- Your physical or electronic signature.
B. Action After Receiving a Valid Infringement Notice
After receiving a valid and complete infringement notice, HUSTLORY may:
- Remove or disable access to the allegedly infringing content, product listing, digital file, artwork, template, image, or related material;
- Notify the user, contributor, or content provider responsible for the removed or disabled material, where applicable; and
- Take further action against repeat infringers, which may include removing additional content, limiting access, or terminating service access where appropriate.
C. Procedure for Submitting a Counter-Notice
If the person responsible for the removed or disabled content believes that the material was removed by mistake or misidentification, or believes they have the legal right to use the material, they may send a counter-notice to the Designated Agent.
The counter-notice must include the following information:
- Identification of the content, product listing, digital file, artwork, template, image, or material that was removed or disabled, including where it appeared on the HUSTLORY website before removal;
- A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your contact information, including your full name, mailing address, telephone number, and email address;
- A statement that you consent to the jurisdiction of the Federal Court for the judicial district in which your address is located, or if your address is outside of the United States, for the judicial district in which HUSTLORY is located, and that you will accept service of process from the person who submitted the original infringement notice or their agent; and
- Your physical or electronic signature.
If HUSTLORY receives a valid counter-notice, we may forward a copy of the counter-notice to the original complaining party. Unless the rights holder files a legal action seeking a court order against the person responsible for the content, the removed material may be restored within 10 to 14 business days or more after receipt of the counter-notice, at HUSTLORY’s discretion.
Please note that under Section 512(f) of the DMCA, any person who knowingly misrepresents that content or activity is infringing, or that content was removed by mistake, may be subject to liability for damages, including attorney’s fees.
